By accessing and using FytCircle ("the App"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

FytCircle is a fitness tracking and social wellness application that allows users to:

• Track fitness activities, steps, and calories
• Set and monitor personal health goals
• Connect with friends and participate in fitness challenges
• Join fitness groups and communities
• Share fitness achievements and progress

3. Eligibility

You must be at least 13 years of age to use FytCircle. By using the App, you represent and warrant that you meet this age requirement. Users under 18 should have parental consent.

4. User Accounts

4.1 Account Creation

• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must not share your account credentials
• You must notify us immediately of unauthorized access

4.2 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in prohibited activities.

5. User Conduct and Responsibilities

• Violate any laws or regulations
• Harass, bully, or abuse other users
• Post offensive, inappropriate, or harmful content
• Impersonate others or create fake accounts
• Spam or send unsolicited messages
• Manipulate fitness data or cheat in challenges
• Attempt to hack, disrupt, or damage the App
• Collect other users' personal information
• Use the App for commercial purposes without permission

6. Health and Fitness Disclaimer

• The App does not provide medical advice or diagnosis
• Always consult healthcare professionals before starting new fitness programs
• Fitness data provided is for informational purposes only
• We are not responsible for health consequences from using the App
• Stop any activity if you experience pain or discomfort

7. Health Data Permissions

FytCircle integrates with Google Fit (Android) and Apple HealthKit (iOS):

• You control which health data is accessed
• You can revoke permissions at any time
• Health data is encrypted and secured
• We do not sell your health data

8. User Content

8.1 Your Content

You retain ownership of content you post (photos, comments, posts). By posting, you grant us a license to use, display, and distribute your content within the App.

8.2 Content Moderation

We reserve the right to remove content that violates these Terms or community guidelines.

9. Social Features and Challenges

9.1 Friend Connections

• You control who can see your activities
• You can remove friends at any time
• Blocked users cannot interact with you

9.2 Challenges and Groups

• Challenge rules are set by challenge creators
• Cheating or data manipulation results in disqualification
• We do not guarantee prizes or rewards from user-created challenges

10. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data.

11. Intellectual Property

• FytCircle and all associated trademarks are our property
• You may not copy, modify, or distribute our code or designs
• All content in the App (excluding user content) is protected by copyright

The App integrates with third-party services (Google Fit, Apple HealthKit, etc.). Your use of these services is subject to their respective terms and policies.

13. Disclaimers and Limitations of Liability

13.1 "As Is" Service

FytCircle is provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free service
• Accuracy of fitness data
• Compatibility with all devices
• Availability of specific features

13.2 Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

• Indirect, incidental, or consequential damages
• Loss of data or profits
• Health issues or injuries related to fitness activities
• Actions of other users

14. Indemnification

You agree to indemnify and hold FytCircle harmless from claims, damages, and expenses arising from your use of the App or violation of these Terms.

15. Changes to Terms

We may update these Terms from time to time. Significant changes will be communicated through the App or via email. Continued use after changes constitutes acceptance.

16. Termination

You may terminate your account at any time through the App settings. Upon termination:

• Your account will be deactivated
• Your data will be deleted per our Privacy Policy
• You lose access to all App features

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction where FytCircle operates. Any disputes will be resolved through binding arbitration, except where prohibited by law.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
